The prayer in the present petition under Section 528 of BNSS, 2023 is for the issuance of directions to respondent Nos.1 to 3 to take steps that there is no obstruction in plying of the vehicle of the petitioner and to take legal action against respondent Nos.4 and 5, who are trying and making an attempt to forcibly take away the vehicle of the petitioner bearing registration number PB-11-DG-4795. 2.

At the very outset, the counsel for the respondent Nos.4 and 5 - HDFC Bank contends that there is an order dated 21.01.2026 of the Debt Recovery Tribunal appointing a receiver to take possession of the vehicle on account of the default in repayment of the loan on the part of the petitioner. He however states that the vehicle will be repossessed in accordance with law.
