In the present petition, the prayer of the petitioner is with regard to expunge the adverse remarks in the Annual Confidential Report relating to period from April, 99 to March, 2000.

The writ petition was filed in the year 2001 and concededly, the petitioner was promoted thereafter. The petitioner is claiming that by expunging the adverse remarks, he should be promoted to the further post from the date his junior has been promoted. Concededly, no such junior has been made party and it is also a conceded fact that the petitioner has already retired from service in May, 2017 from the post of Executive Director, hence, the petitioner has already got the benefit of promotion and has retired and as such the claim raised does not survive and also in view of the fact that as per settled principle of law, no relief can be granted in absence of a party who will be affected and in the present case, grant of relief will affect the HARSHA RANI 2025.07.04 15:50 I attest to the accuracy and integrity of this document
