Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.156 dated 30.05.2013 under Sections 353, 332, 186, 382, 427, 148 and 149 IPC (Sections 325, 326 and 307 IPC added later on), registered at Police Station Sadar Nakodar, District Jalandhar City.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. It has been brought to the notice of this Court that the petitioner has not been declared as proclaimed offender in this case and he has also Vineet Gulati 2017.08.04 10:23 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-23244 of 2017 -2not been tried along with other four accused nor summoned by the trial Court under Section 319 Cr.P.C. The other accused, against whom the challan was presented, have already been acquitted by the trial Court. The petitioner is apprehending his arrest.
Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where petitioner is entitled to benefit of anticipatory bail. Therefore, present petition is allowed. It is ordered that in the event of arrest, the petitioner be released on bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, he shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
