*** Sudhir Mittal, J. (Oral) The petitioner has been suspended from the post of Sarpanch and her appeal has been dismissed. The order of suspension has been passed on allegations of embezzlement. Detailed inquiry has yet to be conducted. Learned counsel for the petitioner has argued that enquiry report dated 18.02.2022 conducted by the District Social Audit Coordinator in the office of the Additional Deputy Commissioner-cum-Additional District Program Coordinator (MGNREGA), Sri Muktsar Sahib, shows that the Gram Rozgar Sewak was guilty of manipulation of MGNREGA funds. This point was raised before the Appellate Court but has not taken the same into consideration. A perusal of the order of the Appellate Court shows that in fact it has not taken into consideration this point.
Thus, learned counsel for the petitioner was asked to show that this point was in fact raised in the grounds of appeal but he has failed to do so. Thus, the argument cannot be accepted. The Appellate Court has returned a finding that public funds have been lying in the private account of the petitioner for quite long time and no error has POONAM RATHORE 2022.04.
C.W.P. No.7549 of 2022 -2been pointed out in this finding. Thus, the petitioner is not entitled to succeed. The writ petition has no merit and is accordingly dismissed.
