The petitioner is alleged to have given a push to Mewa Singh, on account of which he fell on the cot and died. Counsel for the petitioner has vehemently contended that no offence is made out qua the petitioner, even if the allegations are presumed to be correct. He further submits that the petitioner did not have any knowledge or intention to harm or cause death of Mewa Singh. It has been argued that the report of Histopathology has not yet been received. I have considered the contentions of counsel for the petitioner. It will be pre-mature, at this stage, to enter into the controversy whether the petitioners is directly or indirectly responsible for the homicide of Mewa Singh. The investigation is at initial stage. No ground is made out to grant the concession of pre-arrest bail to the petitioner. Dismissed without prejudice to the right of the petitioner to seek the concession of regular bail, in accordance with law.
