This is a Criminal Writ Petition under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the official respondents to protect the life and liberty of the petitioner at the hands of respondent Nos.4 to 15. Learned counsel for the petitioner would contend that the petitioner is a 51 years old divorcee who is living on her own and she is being harassed by the private respondents No.4 to 15. In this regard two representations, both dated 22.03.2021 (Annexures P-1 and P-2), have been sent to the SHO, PS Tibba, District Ludhiana and the Commissioner of Police, Ludhiana, respectively. However, no action has been taken on the same.

Learned counsel for the petitioner would further contend that he limits his prayer in the present petition and would be satisfied at this stage if a direction is issued to the official respondents to decide the representations in accordance with law.

On the asking of the Court, Ms. Samina Dhir, DAG, Punjab has joined the session through video conferencing and accepts notice on behalf of respondent Nos.1 to 3. Since the matter is not being decided on merits, the service on the other respondents is dispensed with. Heard learned counsel for the parties.

Without expressing any opinion with regard to the allegations made in the petition or in the representations or the submissions advanced by learned counsel for the petitioner, the present petition is disposed off with a direction to the Commissioner of Police, District Ludhiana (respondent No.2) to consider the representations dated 22.03.2021 (Annexures P-1 and P-2) and take necessary action as per law.

It is, however, made clear that this order shall have no effect on any other civil or criminal proceedings, if any, instituted/pending against either of the parties.
