Today also the learned counsel appearing for the appellant states that he has no instructions in the matter. 3.

As per the office report, notice issued to the appellant has been received back unserved with the report that no factory exists at the given address. This is the only address which was given in the memo of parties as well as in the judgments and decrees of both the Courts. In view thereof, this Court is left with no other option but to dismiss the present appeal for nonprosecution. 4.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
