Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.26 dated 05.03.2018 under Sections 420 and 120-B IPC, registered at Police Station Phase 8, Mohali, District SAS Nagar.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per FIR, a car make Land Rover was given to present petitioner, who was a dealer and he sold the same to someone else. CRM No.M-24276 of 2018 -2complainant. Learned counsel for the petitioner stated that petitioner has already paid `12 lakhs. During arguments, it has been brought to the notice of this Court that price of the car is `2 crores and loan amount of `80 lakhs is still to be paid to the bank.

Keeping in view the facts and circumstances of the case, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail. The petitioner is required for custodial interrogation. Therefore, finding no merit in the present petition, the same is dismissed. The order dated 31.05.2018 granting interim bail to the petitioner stands vacated.

However, nothing stated above, shall constitute my opinion on merits of the case.
