(ORAL) The instant writ petition has been filed under Article 226/227 of the Constitution of India seeking a writ in the nature of certiorari for quashing order dated 13.03.2020 (P-4) passed by respondent No.3 vide which direction has been issued to the respective Commandant to terminate the services of the petitioner by adopting a proper procedure. Learned counsel appearing on behalf of the petitioner would contend that the petitioner was appointed on probation for three years, which has been duly completed by the petitioner. Petitioner has also passed basic training course, however, respondent No.3 vide order dated 13.03.2020 issued directions to the respective Commandant to terminate service of the petitioner by following due procedure.

The aforesaid order was based on the fact that the merit list was revised and name of the petitioner was not found in the revised merit list. Notice of motion was issued as far back as 20.03.2020 and the proceedings under the show cause notice (P-4) were permitted to continue with a further rider that final order be not passed. CWP No.7246 of 2020 (O&M) -2Today the matter is taken up for hearing and Ms. Jasleen Kaur, AAG, Punjab on instructions from Sr. Constable Gurharpreet Singh would submit that merit list has now attained finality and by virtue of the merit list, petitioner is in service and posted in the Armed Police Cadre at Jalandhar. In view of the statement that has been made at bar by the counsel appearing on behalf of the respondent-State that petitioner is in service on the basis of the merit list, order dated 13.03.2020 (P-4) issued by respondent No.3 is set aside. The writ petition stands disposed of in the above terms. In case, grouse of petitioner still survives, he will be at liberty to revive the instant petition.
