(ORAL) The Petitioner has preferred this writ petition for the issuance of an appropriate writ in the nature of mandamus directing the respondents to release the amount of leave encashment, provisional pension, GPF along with interest in terms of Rule 12 and 81 of the Haryana Civil Services (Pension) Rules, 2016.
Learned counsel for the petitioner submits that the petitioner has already filed number of representations on 13.12.2022 and 04.01.2023 (Annexures P-11 to P-13) attached with this writ petition with a request to decide his representations in the light of Rule 12 and 81 of the Haryana Civil Services (Pension) Rules, 2016 as the case of similarly situated employee namely Sh. D.R. Bhaskar, Chief Engineer has already been considered and accepted by the respondent No.1 on the same subject matter as involved in the present writ POONAM BHATT 2023.03.24 17:04 I attest to the accuracy and authenticity of this Judicial Record/Decree/Document, which is scanned copy of the original

At this stage, learned counsel for the petitioner submits that the petitioner would be satisfied in case his representations dated 13.12.2022 and 04.01.2023 attached with this writ petition as Annexures P-11 to P-13 are directed to be decided by the competent authority/respondent No.1 in accordance with law in a time bound manner.

On the asking of the Court, Ms. Palika Monga, DAG, Haryana accepts notice on behalf of the respondents No.1 and
2. In the very nature of prayer made by the learned counsel for the petitioner, the service qua respondents No.3 to 5 is dispensed with at this stage as no order pre-judicial to the interest of anyone is being passed.
Competent authority/respondent No.1 is directed to decide the representations of the petitioner dated 13.12.2022 and 04.01.2023 (Annexures P-11 to P-13) in accordance with law preferably within a period of two months from the date of receipt of certified copy of this order.
