Prayer made in the instant petition under Section 438 Cr.P.C. is for grant of pre-arrest bail to the petitioner in FIR No. 06 dated 29.05.2015 for offence under Section 13(1)(D) read with Section 13 (2) of the Prevention of Corruption Act, 1988 and Sections 409, 420, 467, 471and 120-B of Indian Penal Code (IPC), registered at Police Station Vigilance Bureau, Mohali. Learned counsel for the petitioner submits that the period for which offence relates is from the year 2004 to 2009 and FIR was registered in 2015. The main person involved in the alleged offence was the Superintending Engineer. It is further submitted that there is no evidence so far as the petitioner is concerned.

FIR pertains to preparing fake sale orders regarding nine out-of-use road-rollers and missing of 10 files from the office record of PWD. Davinder Singh, Superintendent (since retired), is said to have prepared the false sale orders and put the seal of Assistant Controller of Stores and also fake despatch numbers. CRM-M-23289 of 2015 -2- (B&R). The matter was thoroughly enquired into by the Vigilance Bureau and then the FIR was registered. It has been found that Davinder Singh Superintendent, the petitioner, who was posted as Senior Assistant and one Jatinder Kaur, Junior Assistantcum-Record Keeper alongwith Paramjit Singh c/o M/s Paras Road Sales Spare, Char Wing Market, Kolkata were involved in committing the crime.

The matter relates to the public record and funds and is so serious that it has to be cracked by custodial interrogation for which there is no scope of giving extraordinary concession of pre-arrest bail.

Dismissed.
