Present petition has been filed under Section 528 of BNSS, 2023, seeking quashing of FIR No.13, dated 14.01.2025, under Sections 127(6), 3(5) of BNS, 2023, registered at P.S. City Kapurthala, District Kapurthala, and all consequences proceedings arising therefrom. 2.

At the outset, learned State counsel has filed the short reply dated 29.03.2025 in Court today, which is taken on record, subject to all just exceptions. Office to tag the same at appropriate place. A copy thereof has been handed over to the counsel for the petitioners.

As per paragraph No.5 of the short reply, cancellation report has already been recommended on 10.03.2025, in the present case. For reference, paragraph No.5 is reproduced here-under:- "5.

That it is respectfully submitted during the investigation it has come on the record that Shilpa daughter of complainant Paramjit Kaur JAWALA RAM 2025.04.04 18:39 I attest to the accuracy and authenticity of this document

CRM-M-13155-2025 - 2 - was having love affair with petitioner no.1 - Jaskaran Singh and she wanted to marry him. But the complainant and other members of her family were against this relationship. Thereafter, Shilpa marry petitioner no.1 on 13.01.2025 and was major (Date of Birth - 29.03.1999) at the time of contacting the marriage with the petitioner no.1. After her marriage she got recorded her statement to the Investigating Officer on 10.03.2025 that she was neither abducted nor detained by any person including the petitioners rather she went of her own will from the house of her parents to marry petitioner no.1. On the basis of her statement and investigation of the case, the officer incharge of the Police Station Kapurthala recommended a cancellation report on 10.03.2025 in the said FIR No.13 dated 14.01.2025 under Section 127(6), 3(5) of Bharatiya Nayaya Sanhita 2023 registered at Police Station City Kapurthala, District Kapurthala." 4.

Faced with the situation, counsel for the petitioners submits that she does want to press the prayer made in the present petition, at this stage. However, liberty be granted to avail the remedy as per law, if necessity arises in future.

Petition is disposed of, as having been not pressed with liberty as sought and recorded here-above.
