The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to count his daily wage service as qualifying service for the purpose of pensionary/retiral benefits.

This is second round of litigation. The petitioner on the earlier occasion preferred CWP No.4803 of 2021 seeking direction to respondents to count his daily wage service as qualifying service for the purpose of pensionary/retiral benefits. It was further prayed in the said petition that he be granted benefit of old pension scheme. The said petition was disposed of vide order dated 13.03.2023. 3.

Learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to avail remedy as permissible by law.
