The petitioners seek grant of anticipatory bail in respect of FIR No.85 dated 25.4.2018 under Section 17 of POCSO Act and Sections 120-B, 366-A, 363, 376 IPC, Police Station Chheharta, District Amritsar consequent upon petitioners having been summoned by the trial Court with the aid of Section 319 Cr.P.C. vide order dated 7.2.2019 so as to face trial for offence under Section 17 of POCSO Act and Section 120-B IPC along with main accused Hardial Singh.

Pursuant to interim directions issued by this Court all the petitioners except petitioner No.4 are stated to have appeared before the trial Court and have furnished bail bonds.

Learned State counsel has informed that petitioner No.4 has been declared a proclaimed offender.

The petitioners were summoned with the aid of Section 319 Cr.P.C. on the allegations that they were co-conspirators with the main accused Hardial Singh who had allegedly raped the victim.

In view of the fact that the petitioners except petitioner No.4 have already appeared before the trial Court and have furnished their bail bonds and are no longer required to be detained behind bars, the petition qua all the petitioners except petitioner No.4 is accepted and the interim directions issued vide dated 19.3.2019 by this Court are hereby made absolute qua petitioners except petitioner No.4 with liberty to the trial Court to impose with liberty to the trial Court to impose any other condition as deemed fit to ensure regular appearance of the any other condition as deemed fit to ensure regular appearance of the petitioners during proceeding of trial.
