AMIT RAWAL J. (Oral) Learned counsel for the appellant submits that during the pendency of the appeal, the parties have compromise the matter. This Court, on 14.02.2018 passed the following order:- "Mr. M.L. Saggar, Advocate learned senior counsel assisted by Ms. Armaan Saggar, Advocate appearing on behalf of the appellant submits that he could not get the instructions with regard to some settlement which has approved owing to the passage of time for the suit was filed by Jangir Kaur motherin-law against her daughter-in-law whose husband Hargurdarshan Singh had died in an accident, therefore, the appellant -defendant has become owner by virtue of decree dated 30.8.1986. On the demise of Hargurdarshan Singh, Bharpur Singh set up a Will of the deceased Hargurdarshan Savita 2018.05.15 10:47 I attest to the accuracy and integrity of this document High Court Chandigarh

RSA No.2480 of 1995 {2} Singh in his favour whereby the plaintiff claimed herself to be an executor thereby resulting into filing of the suit for declaration which has erroneously been decreed. Adjourned to 09.5.2018 enable to counsel for the appellant to seek instructions.

The parties are not coming forward for the compromise. The appeal is of 1995.

In view of the aforementioned fact, I am of the opinion that no cause of action survives in the present appeal. Dismissed for non-prosecution. Liberty is granted to the appellant for revival of the appeal in case something survives.
