The present appeal pertains to the year 1995. Vide order dated 07.05.2024 fresh notice was issued to the appellant as counsel representing him had pleaded no instructions in the matter. As per the Office report, the sole appellant remains unserved due to incomplete address. There is no other address available with the Court for effecting service on the appellant except the one mentioned in the memo of parties and in the judgments and decrees passed by the Courts below and is the same on which the notice was sent. Learned counsel appearing on behalf of the appellant today again pleads no instructions in the matter.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.
