Petitioners are employees of a Banking Company. As per the allegations of complainant-respondent No.4, a cheque deposited by the complainant for a sum of Rs.1,80,000/- with Canara Bank, Mai Hira Gate, Jalandhar, for crediting the same in the account of his wife Meenakshi, was not deposited in her account but one Sunil Kumar was found to have received the payment from the Oriental Bank of Commerce, Adarsh Nagar, Jalandhar, against the said cheque after tampering the cheque. It appears that Sunil Kumar has not yet been traced. The employees of the bank, i.e., the petitioners have entered into compromise with the complainant. The FIR regarding misappropriation of money in above said manner, without tracing the main culprit cannot be permitted to be

CRM-M-23357-2015 (O&M) compounded.

No ground is made out for quashing of FIR on the basis of compromise till the main accused named in the FIR is traced and his culpability is determined by investigation. The petition is dismissed, at this stage.
