RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to petitioner Reena in case FIR No.0092 dated 08.05.2018 registered under Section 420 IPC at Police Station City Kapurthala, District Kapurthala.

Learned State counsel, on instructions from ASI Harparshad, has fairly stated that agreement in question has not been signed by the petitioner rather is signed by her husband.

Heard.

Perusal of the file shows that vide judgment and decree dated 02.11.2016 (Annexure P-2), her husband has divorced the petitioner. Therefore, it is apparent on the record that there is no relationship of husband and wife between the petitioner and signatory of the agreement in question. Consequently, petitioner having no role in the impugned transaction is entitled for anticipatory bail.
