Learned counsel for the petitioner submits that the custody of the child has been handed over to the mother; therefore, nothing survives in the present petition.

In light of the above, the present petition stands disposed of. However, it is made clear that the rights of the parties shall not be prejudiced qua the litigation for the custody of the child in the Court of competent jurisdiction.
