Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.780 dated 18.11.2015 under Sections 302/34 IPC, registered at Police Station City Yamuna Nagar, District Yamuna Nagar.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per the allegations in the FIR, the present petitioner along with Monu and Chaman caught hold Shivam, brother of the complainant. CRM No.M-24330 of 2016 -2the road side, gave blow on the head of Shivam, upon which he died. Mangal and Chaman were found innocent but later on, they were summoned under Section 319 Cr.P.C.

Keeping in view the facts and circumstances of the present case, nature and gravity of the offence and in view of the fact that petitioner has been named in the FIR and specific act has been attributed to him and furthermore, 14 witnesses out of 16 have already been examined, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
