None **** AMIT RAWAL, J. (ORAL) As per office report, notice issued to the appellant has been received back unserved with the report that he has died. The present appeal has been filed by the appellant-plaintiff against the concurrent findings of fact, whereby the suit of the plaintiff seeking declaration and permanent injunction has been dismissed by both the Courts below on the ground that the suit was not maintainable when the plaintiff is held to be not in possession of the suit land. No steps have been taken to implead the LRs of the appellant. It appears that the parties must have resiled with the factual aspect.

Dismissed for non-prosecution.

Liberty is granted to revive the matter in case something survives.
