Petitioner has filed this fourth petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.168 dated 18.06.2014 under Sections 15, 27A and 21 of the NDPS Act and Sections 420, 411 and 120-B IPC, registered at Police Station Sadar Tohana, District Fatehabad. Notice of motion.

On asking of the Court, Mr.D.R.Singla, Deputy Advocate General, Haryana, who is present in the Court, accepts notice on behalf of the respondent-State and contests the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. Police record is also available.

From the record, I find that this is the fourth bail application filed by the petitioner. The recovery from the petitioner in the present case Vineet Gulati 2016.08.08 10:40 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-24352 of 2016 -2is 182 kgs. of poppy husk, which falls under commercial quantity and Section 37 of the NDPS Act bars the grant of bail to the accused in case of commercial quantity.

Therefore, finding no merit in the present petition, the same is dismissed.

However, as the petitioner is in custody since 20.06.2014 and the case is stated to be fixed for final argument, therefore, the trial Court is directed to expedite the trial of the case.
