**** JAISHREE THAKUR, J. (ORAL) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.005 dated 05.01.2017, registered at Police Station Ganaur, Distt Sonepat, who has been booked for having committed the offence punishable under Section 328/34/498-A IPC (Section 304-B IPC added lateron).

Pooja (now deceased) was the wife of nephew of petitioner and the marriage of nephew of petitioner i.e Sandeep was solemnized with Pooja on 13.12.2015. Petitioner was not residing in the matrimonial house. Further the allegation is against the husband of the deceased, who in his disclosure statement himself stated that before her death, he had fight over phone. No role has been attributed to the present petitioner. Learned State counsel on instructions has informed the Court that the challan has already been presented on 05.04.2017 against the husband of the deceased and challan against the present petitioner has also been presented on 11.06.2017. Petitioner is in custody since 13.05.2017.

Keeping in view the fact that the trial is likely to take some time to conclude and the fact that the present petitioner is a distant relative of the accused-husband, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Sonepat.
