For the reasons stated in the application, the same is allowed. CR-1752-2024 1.

The present petition has been filed under Article 227 of the Constitution of India seeking issuance of a direction to the learned Principal Judge, Family Court, Pathankot for time-bound disposal of the case bearing HMA No.1359 of 2022 titled as Shakti Kumar Vs. Prem Lata (Annexure P-1).

As per the dashboard of Family Court, Pathankot available on the website of National Judicial Data Grid, there are 912 cases pending before the Family Court concerned including 3 to 5 years' old cases. Yogesh Sharma 2024.03.22 10:11 I attest to the accuracy and integrity of this order/judgment.

Hon'ble Supreme Court in the case titled as High Court Bar Association, Allahabad Vs. State of U.P. & Ors. [2024 (2) RCR (Civil) 199] has held in para No.37(c) as under :

"37(c) Constitutional Courts, in the ordinary course, should refrain from fixing a time-bound schedule for the disposal of cases pending before any other Courts. Constitutional Courts may issue directions for the timebound disposal of cases only in exceptional circumstances. The issue of prioritizing the disposal of cases should be best left to the decision of the concerned Courts where the cases are pending"

No exceptional ground is made out in the present case for issuance of directions to the Court concerned to dispose off the matter in a time bound manner. The present revision petition is accordingly dismissed.
