**** RAJ MOHAN SINGH, J.(Oral) Petitioner has preferred this writ petition for the issuance of an appropriate writ in the nature of certiorari seeking quashing of impugned orders wherein licence granted to the petitioner in respect of public distribution shop was cancelled. The present writ petition was filed in the year 2019. After adjourning the case on 09.04.2019, 14.05.2019 and 05.08.2019, the order came to be passed on 02.12.2019, directing the petitioner to place on record the reply that had been submitted to the show cause notice and which ultimately led to passing of the impugned order dated 29.12.2016 by the District Food and Supplies Controller, Narnaul cancelling the public distribution shop licence.
The needful was ordered to
be done within a period of four weeks and the case was adjourned for 28.01.2020. On 28.01.2020 needful in the context of order dated 02.12.2019 was not done and last opportunity was granted to the petitioner for complying with the order dated 02.12.2019.
Thereafter the case was again taken up after a period of two year due to COVID-19 on 11.05.2022 and following order was passed by the Co-ordinate Bench of this Court:- "On 02.12.2019, the petitioner had been directed to place on record reply submitted to the show cause notice. However, the same has not been done. On the previous date i.e. 28.01.2020, last opportunity was sought to place on record the said reply. Today again, a request for adjournment is being made. Although, the same is not justified, in the interest of justice, adjourned to 21.10.2022 finally.
(SUDHIR MITTAL) JUDGE 11.05.2022 Ramandeep Singh"
Perusal of the aforesaid order would show that last opportunity was sought by learned counsel for the petitioner to comply with the previous orders. Even after observing that further adjournment is not justified, the case was adjourned for today finally.
Today also, learned counsel appearing on behalf of the petitioner seeks adjournment.
In view of above facts and circumstances, no further indulgence can be granted. The case is dismissed as withdrawn with liberty to the petitioner to file a fresh petition along with the documents as required by this Court vide order dated 02.12.2019.
