Learned counsel for the petitioners contended that petitioners have been summoned under Section 319 Cr.P.C. without there being any legal evidence. There is more than one defence material which has not been considered at all by the learned trial Court and as such orders dated 29.7.2016 & 8.9.2016 are liable to be set aside. Having considered the submissions made by learned counsel for the petitioners and the fact that the learned trial Judge passed the order on application 319 Cr.P.C. after considering the material and legal evidence available on the file i.e. PW.1 Vijay Kumar, which was considered sufficient evidence to proceed further against the present petitioners as co-accused by invoking the provisions of Section 319 Cr.P.C.
