 "#$ !% Allegations against the petitioners namely Rajwinder Singh, Baldev Singh and Mithu Singh in both the above detailed petitions filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.51 dated 17.05.2015 registered at Police Station Sardulgarh under Sections 307/382/324/323/427/148/149 IPC read with Sections 25/27 of the Arms Act, are that Rajwinder Singh and Mithu Singh both RATTAN PAL SINGH 2015.08.13 17:00 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court



 

   armed with Dangs and Baldev Singh empty handed had caused injuries to the complainant victim Guriqbal Singh. Petitioner Rajwinder Singh is attributed single injury on the little finger of right hand which is detected to be simple in nature, petitioner Baldev Singh being handicapped and empty handed has not been attributed any injury whereas petitioner Mithu Singh is also attributed single injury on the left knee of the victim which is also opined to be simple in nature. The contentions of learned counsel for the petitioners that they are in custody since last more than three months and that it is a case where applicability of Section 307 IPC is a debatable issue as it is alleged that the accused have fired in the air have not been controverted by learned State counsel.

In view of the incarceration of the petitioners and that the investigation and trial will take a long time to conclude together with the fact that applicability of Section 307 IPC is a debatable issue, this Court is of the opinion that no useful purpose will be served by keeping the petitioners behind bars. Accordingly, they are ordered to be released on regular bail to the satisfaction of trial Court.
