***** CORAM: HON'BLE MS. JUSTICE JAISHREE THAKUR

Present:

Mr. P.K.S. Phoolka, Advocate, for the petitioners.

Mrs. Anju Arora, Addl. A.G., Punjab.

**** JAISHREE THAKUR, J. (ORAL) The instant petition under Section 482 Cr.P.C. has been filed by the petitioners with a prayer for directing respondent Nos. 1 to 3 to protect the life and liberty of the petitioners and their family members at the hands of respondent Nos.4 to 13, who are harassing the petitioners. Learned counsel for the petitioners draws attention of this Court to the photographs that have been annexed with the petition as Annexure P-1 showing injuries that have been inflicted upon the petitioners. It is argued that the said photographs would reflect that it is not a case in which a cancellation report can be filed. It is further contended that the respondents are part of land Mafia and intend to grab the land of the petitioners herein.

CRM-M-24378-2016 -2- Mrs. Anju Arora, learned Addl. A.G., Punjab submits that the matter has been investigated and a cancellation report has already been approved and submitted in the Court. The remedy available to the petitioners herein now would be to challenge the said cancellation report. I have heard learned counsel for the parties and in view of the fact that a cancelation report has been submitted, the petitioners herein are at liberty to avail appropriate remedy of challenging the said cancellation report.

However, before parting with the order, it is directed that in case the petitioners approach the official respondents for protection of their life and liberty at the hands of the private respondents, the same will be considered and appropriate action taken thereon. The petition stands disposed of accordingly.
