(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 65 dated 23.10.2015, registered at Police Station City-II, Abohar, District Fazilka, who has been booked for having committed the offence punishable under Sections 363/366A/120-B IPC (challaned under Sections 363/366-A/368/376/212/120-B IPC and Section 3/4 of POSCO Act).

The allegations against the petitioner is that she had incited the minor daughter of the complainant to perform the marriage with Gurjant Singh (brother of the petitioner).

The prosecutrix in her statement under Section 164 Cr.P.C stated that she was willing to go with Gurjant Singh and even compelled Gurjant Singh to take her along with him else she would commit suicide. Further the family of the prosecutrix had beaten Gurjant Singh as well as GAURAV ARORA 2016.08.01 11:19 I attest to the accuracy and integrity of this document

Crl. Misc. No. M-24383 of 2016 -2Rupinderjit Kaur @ Rupi (daughter of the complainant). She thereafter developed physical relationship with Gurjant Singh with her own consent. She further stated that she has been sent to Nari Niketan, as she does not want to return back to home.

Learned State counsel on instructions from ASI Pawan Kumar has informed the Court that the prosecutrix is staying in Nari Niketan at Jalandhar and is about 17 years of age as of today. After framing of charges, there are total 22 witnesses and none has been examined so far. Petitioner is in custody since 23.12.2015.

Keeping in view the period of incarceration of the petitioner and the fact that the complainant has pressurized Gurjant Singh to take her along with him, this court feels that there is no need to detain the petitioner any longer, who is sister of the accused-Gurjant Singh. Accordingly, the present petition is allowed.
