The present appeal pertains to the year 1995. Vide order dated 16.12.2023 learned counsel for the appellant had informed that he was not in touch with the appellant and had prayed fresh notice be issued to the appellant. Since none had appeared on behalf of the respondents, fresh notices were issued to the parties returnable today. As per the service report, the sole appellant as well as respondent Nos.1 to 3 have died. Respondent No.4 was not present at the time of service and his daughter-in-law accepted the notice but she refused to sign the same. No one has come forward to get themselves impleaded as legal representatives of the appellant as well as respondent Nos.1 to 3 nor any counsel has put in appearance on their behalf. None has also appeared on behalf of the respondent No.4. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

Dismissed for non-prosecution with liberty to the appellant to get the same revived in case anything survives therein. Pending applications, if any, also stand disposed off.
