(ORAL) This is the defendant/appellant's second appeal against the concurrent findings returned by the learned trial Court vide judgment and decree dated 12.09.1992, decreeing the 'suit for specific performance of an agreement to sale dated 17.01.1986' filed by the plaintiff-respondents herein; and by the Ist Appellate Court, vide judgment and decree dated 19.05.1995 in Civil Appeal No. 5 dated 20.10.1992, whereby appeal preferred by the appellant was also dismissed.

At the outset, learned Senior Counsel for the appellant submits that the instant second appeal has been rendered infructuous and may be disposed of as such, as the matter has been compromised between the parties.

Learned counsel for the respondents admits the factum of RISHU KATARIA 2023.12.06 17:59 I attest to the accuracy and authenticity of this order/judgment
