SUVIR SEHGAL, J. (Oral) Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.64 dated 08.03.2020 registered under Section 61 of the Punjab Excise Act, 1914 at Police Station Sangat, District Bathinda. On 08.05.2020, this Court passed the following order:- "Court has been convened through video conferencing due to Covid-19 pandemic.

Counsel for the petitioner has urged that a false case has been planted against the petitioner. 40 kgs of lahan in a silver vessel alongwith plastic drum containing 80 kgs lahan apart from the working still was allegedly recovered from the house of the petitioner but the petitioner was never apprehended from the spot. He submits that recovery has already been effected and that the petitioner is not involved in any other matter. Notice of motion.

CRM-M-12076 of 2020 {2} Mr.H.S.Sullar, D.A.G., Punjab is present through video conferencing and opposed the bail application but he could not deny the fact that there is no other matter of similar nature pending against the petitioner.

Adjourned to 13.08.2020.

Meanwhile, the petitioner shall join the investigation and would come present as and when called for and in the event of arrest, he shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting Investigating Officer. He shall also abide by the conditions as specified under Section 438(2) Cr.P.C."

Learned State counsel, on instructions from HC Joginder Singh submits that the petitioner has joined the investigation and is no longer required for custodial interrogation. He has further instructions to state that the petitioner is not involved in any other criminal case. In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 08.05.2020 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
