Prayer made in the present petition is for quashing the order dated 21.01.2004, Annexure P-6, whereby respondent No.3 was promoted, might not due to efflux of time, even be surviving.

Learned State counsel refers to para 3 of the preliminary submission of the written statement dated 10.01.2004 of Joint Secretary to Government of Punjab, Department of Home Affairs and Justice stating therein that in the final seniority list, respondent No.3 and one Mr. R.S. Bajwa, who were appointed against direct quota posts on compassionate grounds were assigned Seniority Nos.31 and 32, while the petitioner was at 35, to which there was no rebuttal by way of filing any replication.
