(Oral) The petition has been filed inter alia seeking a direction to the respondents to consider the petitioner for promotion to the post of Headmaster in High School from the fixed quota of Masters' cadre, to which he belongs, as the posts are lying vacant.

Learned State counsel has referred to a specific averment in the written statement filed on behalf of the respondents that no person junior to the petitioner has been promoted to the post of Headmaster from the cadre of Masters till his retirement from service. It has also been averred that the petitioner was at serial no.3313 in the seniority list of Masters as on 01.01.1979, whereas promotions had been given up to serial no.3310 only. It is a settled proposition of law that an employee cannot claim any right to promotion only because posts are lying vacant. Besides, it remains undisputed that none of the petitioner's junior has been promoted. 4.
In view thereof, there is no merit in the petition, and it stands dismissed.
