A.G., Punjab. **** ANITA CHAUDHRY, J (ORAL) The petitioner is seeking regular bail in FIR No. 97 dated 9.11.2016 registered at Police Station Arniwala, District Fazilka, under Sections 376, 354, 506, 120-B IPC and Section 66/67-A of the Information Technology Act, 2000.

The custody certificate has been placed on record according to which the petitioner is in custody for over one year and one month. Heard.

The complaint had been given by the father against Gurnam Singh, Gagandeep Singh and one Bimla. The police has challaned only Gagandeep Singh. The statement of the victim had been recorded. The prosecution has moved an application under Section 319 Cr.P.C. for summoning the remaining two persons named by the complainant. Crl. Misc. No. M-246 of 2018 -2State counsel submits that the police had recovered the video but it did not contain any obscene photographs. The trial is going at a slow pace and the petitioner is in custody for over a year.

Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate with the condition that the petitioner would not contact the victim or her family or tamper with evidence.
