The petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.309 dated 6.12.2016 registered for the offences under Sections 302, 323, 324, 365 and 34 IPC and Section 25 of Arms Act at Police Station Bawani Khera, District Bhiwani.

Notice of motion was issued in this case.

Mr. Navdeep Singh, learned Assistant Advocate General, Haryana has appeared on behalf of the respondent-State and and Mr. Sunil Chaudhary, learned Advocate has appeared on behalf of the complainant and contested this petition.

Cr. Misc. No.M-12709 of 2019 [2] State counsel and have gone through the record. The present petitioner is named in the FIR and stated to be armed with a knife. There is allegation that he caught hold of hand of the deceased. There is also allegation that earlier they took away Mahesh (since deceased) like a sack and placed him on the bike and Sonu Ahir Phatak Wala was driving the motorcycle. Later on, when the complainant and Ravi followed them, they saw that Sonu Ahir and Chhotu were taking out petrol in a bottle from the motorcycle with a view to burn Mahesh. Mahesh died due to the injuries given to him.

Keeping in view the serious allegations against the present petitioner, I do not find it a fit case where he is entitled to the benefit of regular bail.

Therefore, finding no merit in this petition, the same is dismissed.
