1. The petitioner seeks grant of anticipatory bail in a case registered against him vide FIR No.153 dated 5.3.2020 under Sections 323/353/186/427/506/120-B/224/225 IPC at Police Station City, District Hansi.

2. It is the case of the prosecution that on 4.3.2020 when the police party went to arrest Surender @ Sindhi (petitioner) in connection with FIR No. 352 dated 22.8.2018 under Section 420 IPC registered at Police Station KUK, District Kurukshetra and when they reached his house, said Surender @ Sindhi, upon seeing the police party immediately ran away while calling other members of his family namely his brother Suresh, two sons of his brother Suresh, Naresh @ Lilu Pardhan, wife of Suresh, wife of Surender Singh and 15-20 other unidentified persons, ladies and young persons to KAMAL KUMAR 2020.05.27 20:11 I attest to the accuracy and integrity of this document

CRM-M-12110-2020 (O&M) shoo away the police by throwing stones upon them as it had come there to arrest him. The police was, however, able to apprehend said Surender but the aforesaid persons threw brick-bats at the police and also attacked them with 'sticks' and got said Surender freed.

3. It is further alleged that the said persons even damaged the two official vehicles of the police.

4. The learned counsel for the petitioner has submitted that he was never arrested at the spot and has been falsely implicated by the police and that in any case there is no allegation to the effect that the petitioner had caused injury to any of the police official.

5. Opposing the petition, the learned State counsel has submitted that the allegations levelled in the FIR are duly substantiated from the fact that three injuries were sustained by Head Constable Jaipal and even Head Constable Deepak Kumar sustained as many as five injuries.

6. I have considered rival submissions addressed before this Court.

In view of the fact that two of the police officials were injured and government vehicles were damaged and the entire occurrence has been recorded in CCTV cameras installed at the spot and that the entire occurrence had taken place in order to benefit the petitioner so as to enable him to escape, this Court does not find any special case for grant of anticipatory bail.
