This matter is being taken up for hearing through video conferencing due to outbreak of the pandemic, COVID-19. Petitioners seek compensation on account of unnatural death of Mohan Lal i.e., husband of petitioner No.1, father of petitioners No.2 to 4 and son of petitioner No.5.

It is submitted that Mohan Lal died due to negligence on the part of Municipal Corporation, Ludhiana inasmuch as sewage manhole was left open by the authorities without any cover, reflector or sign board. Mohan Lal fell into the said manhole alongwith his motorcycle while returning home from work on 29.02.2021. It is further submitted that representations were submitted by the petitioners, but to no avail. CWP No.11638 of 2021 -2At this stage, learned counsel for the petitioners restricts the prayer for a decision on representations dated 23.09.2020 (Annexure P13 and P14) in a time bound manner.

Keeping in view the facts and circumstances as well as the limited prayer addressed, but without expressing any opinion on the merits of the case, this writ petition is disposed of with a direction to the competent authority to decide representations dated 23.09.2020 (Annexure P13 and P14), in accordance with law by passing a speaking order, within a period of two months from date of receipt of certified copy of the order. In case compensation is found due towards the petitioners, the same be released to them within six weeks thereafter . ( LISA GILL ) July 05 , 2021.
