ANIL KSHETARPAL, J(Oral) Learned counsel for the respondent, at the outset, pointed out that the order under challenge i.e. summoning order dated 22.04.2014 is revisable.
Learned counsel for the petitioners points out that it may be too late in the day to relegate the petitioners to the alternative remedy. Learned counsel for the respondent submits that the revisional court can be directed to decide the revision petition if filed, on merits. Keeping in view the aforesaid facts, learned counsel for the petitioners prays for permission to withdraw the petition with liberty to file a revision petition before the courts of Sessions. In view thereof, the present petition is dismissed as withdrawn with the liberty aforesaid.
