Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.37 dated 08.09.2015 under Sections 307, 323, 342, 506, 148 and 149 IPC (Section 302 IPC added later on), registered at Police Station Pojewal, District SBS Nagar, Nawanshahr. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that in the present case, the FIR has been registered on the basis of statement of Ravi Kumar. The present Vineet Gulati 2017.03.02 15:55 I attest to the accuracy and authenticity of this document Chandigarh petitioner is named in the FIR. Honey Kumar was beaten by the present

CRM No.M-2369 of 2017 -2petitioner along with other accused and he died due to the injuries. As argued, earlier injured witness was examined and on the application of the prosecution, additional accused have been summoned, which means that the case is at preliminary stage. Keeping in view the facts and circumstances of the present case, nature and gravity of the offence and in view of the fact that there is every apprehension of tampering of the evidence if the petitioner is released on bail, I do not find it a fit case where petitioner is entitled to benefit of regular bail.

Therefore, finding no merit in the present petition, the same is dismissed, at this stage.
