Both, learned counsel for the petitioners and counsel for respondent No.2 have stated that on account of non-appearance of respondent No.2, statement of the parties could not be recorded before the learned trial Court.

It has further been intimated that petitioner No.1 died in 2024. However, amended memo of parties has not been placed on record. Further, a perusal of the proceedings as recorded in the order sheets reveals that the petition for quashing of the FIR, on the basis of compromise, had been filed on 24.03.2024. Thereafter, in terms of order dated 04.11.2024, parties were directed to appear before the learned trial Court. Present on the case file is the report dated 27.02.2025 of the trial Court, vide which the parties had requested for grant of extension of time to get their respective statements recorded. Subsequently thereto, even on 24.04.2025, complainantrespondent No.2 was not present, resultantly, his statement could not be recorded.

It is in light of the factual backdrop as mentioned hereinabove, that the learned counsel for the petitioners seeks permission to withdraw the present petition to file afresh on the same cause of action. 4.
