On 29.11.2023, counsel appearing on behalf of the appellant had stated that he had no instructions in the matter. None had put in appearance on behalf of the respondents. Fresh notices were issued to both the parties. On 03.07.2024 the following order was passed : "As per the office report, notices issued to the appellant and the respondents have been received back unserved with the report that now village of the appellant and the addresses of the respondents fall within District Tarn Taran after bifurcation of District Amritsar. In view thereof, fresh notices be issued to the appellant and the respondents through Civil Judge (Senior Division), Tarn Taran returnable 21.08.2024.

As per office report, the sole appellant as well as respondent No.1 are stated to have died. The legal representatives of both appellant as JITENDER KUMAR 2024.08.22 10:24 I attest to the accuracy and integrity of this order/judgment Chandigarh

RSA-546-1995 -2well as respondent No.1 have not come forward to be impleaded as party in the present case.

In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 4.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
