NIRMALJIT KAUR, J. (ORAL) Heard learned counsel for the petitioner as well as counsel for respondent No.3.

Learned counsel for the petitioner does not dispute that the appeal lies to the Director, Food Civil Supplies and Consumer Affairs Department, Punjab, Chandigarh, whereas he has filed the writ petition without availing the alternative remedy.

In view of the admitted position, the present writ petition is disposed of with liberty to the petitioner to approach the first Appellate Authority, i.e. the Director, Food Civil Supplies and Consumer Affairs at the MEENU 2020.05.13 14:20 I attest to the accuracy and authenticity of this document chandigarh

CWP-7326-2020(O&M) -2first instance. However, the time granted to shift the paddy on expiry of seven days from the passing of the impugned order, dated 04.05.2020, is extended by another ten days. The appeal shall also be filed within these ten days itself.

Taking into account the urgency, the Director, Food Civil Supplies and Consumer Affairs Department is directed to decide the appeal within one month from the date fixed before it. The Appellate Authority shall be at liberty to pass an interim order forthwith on listing of the said appeal after hearing the parties. However, the petitioner shall not take any unnecessary adjournments.
