CORAM:- HON'BLE MR. JUSTICE SURINDER GUPTA

Present:

Mr. N.S. Swaitch, Advocate for the petitioner.

Mr. Ajay Pal Singh Gill, DAG, Punjab.

******* SURINDER GUPTA, J.(Oral) Learned State counsel submits that 9 out of 11 witnesses have been examined and the case is now fixed for tomorrow for remaining evidence.

As per report of trial Court, it is the defence counsel, who has been taking adjournments time and again. The cross-examination of witness PW-4 ASI Paramjit Singh was not concluded even after two years of his examination-in-chief. Similarly, cross-examination of PW-5 ASI Gurmeet Singh was completed after a period of about two years by taking several adjournments and his cross-examination has continued for five days. Keeping in view the fact that prosecution is going to complete its evidence shortly, the instant petition is dismissed. However, the trial Court is directed to expedite trial of the case and try to dispose of the same at the earliest preferably within a period of three months from the date of receipt of copy of this order.
