The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of orders dated 27.02.2001, 24.04.2001 and dated 04.07.2001 (Annexures P-8, P-10 and P-11 respectively) whereby his seniority as Senior Accountant has been changed and he has been placed at Sr. No. 305 in the seniority list. 2.
The petitioner joined respondent as Clerk on 25.04.1972. He claims that he did not avail benefit of Scheduled Caste category at that point of time. He was allocated to Jind and thereafter promoted as Junior Accountant in January'1977. He was extended reservation at that point of time. He was further promoted to the post of Senior Accountant in July'1980. The respondent on 14.10.2000 issued tentative seniority list of Senior Accountants where he was shown at Sr. No. 305. There is no representation of the petitioner. It appears that with the efflux of time the petitioner has lost his interest to pursue the matter. 4.
The matter is pending before this Court since 2001. The Court is left with no other option except to dismiss the petition for non-prosecution. 5.
Dismissed for non-prosecution with liberty to petitioner to move an appropriate application within three months from today, if cause survives.
