G.S.SANDHAWALIA, J. (Oral) Crl. Misc. No. 21171 of 2018 Application has been filed for correction of name of petitioner no. 2. It has been averred that the name has been mentioned as Mohti Sharwan instead of Mohit Sharwan.
Application is allowed.
The name of petitioner no. 2 be read as Mohit Sharwan. In the present petition filed under Section 482 Cr.P.C., the petitioners seek directions to provide protection to the life and liberty from the private respondents No. 4 to 9, who are relatives of petitioner No.1 on account of their marriage which has taken place on 29.05.2018 as per Hindu Religious Rites. The photographs of the marriage are appended as Annexure P-3.
The petitioners are stated to be major, as the date of birth of petitioner No.1 is 31.10.1989 as per Aadhar card (Annexure P-1) and the
date of birth of petitioner No. 2 is also of the year 1979 as per Aadhaar Card (Annxure P-2). Petitioner no. 2 is stated to be a divorced person and is having a daughter aged 8 years.
A representation dated 29.05.2018 (Annexurre P-4) has also been filed with respondent No.2 in this regard. Accordingly, keeping in view the fact that the petitioners have got married and in view of the binding precedent of the Hon'ble Apex Court in Lata Singh Vs. State of U.P. and another 2006(2) SCC (Criminal) 478, the present petition is disposed of with the direction to respondent No.2 to look into the above said representation filed by the petitioners and take appropriate action in accordance with law and provide protection, if so required.
