(Oral) Petitioner is seeking direction to fairly investigate the FIR No.43 dated 10.06.2016, under Section 376 and 511 IPC, registered at Police Station Kot Bhai, District Sri Muktsar Sahib. On notice, reply by way of affidavit has been filed on behalf of respondent Nos.1 to 3 and 5 today in the Court and the same is taken on record.

As per reply, the alleged accused is aged about 50/51 years and he has been declared physically handicapped up to 45%. During inquiry, petitioner has failed to produce any witness to the alleged occurrence. CRM-M-24610-2016 -2stated that petitioner approached them to ask accused Resham Singh to cancel the agreement to sell in question but he did not agree to cancel the same. Accordingly, it was found that present case is false one and the cancellation report has been recommended in the present matter. In view of the above, no further action is required to be taken in the present petition and the same is hereby disposed of by giving liberty to the petitioner to take appropriate remedy, in accordance with law.
