CORAM:

HON'BLE MR. JUSTICE H.S. MADAAN Present:- Mr. S.P. Arora, Advocate with Mr. Himanshu Arora, Advocate for the petitioner. *** The petitioner is feeling aggrieved by order dated 26.4.2018 vide which Additional Chief Judicial Magistrate, Mohali had allowed application under Section 311 Cr.P.C. filed by the complainant for recalling witnesses namely Bhupinder Singh-PW1, Jaspal Kaur-PW6, Navdeep KaurPW7, Kulwant Kaur-PW16 for their re-examination, who had earlier been declared hostile.

I have gone through the impugned order. I do not find any illegality or infirmity therein which might have called for interference by this Court while exercising jurisdiction under Section 482 Cr.P.C. However, the prayer made by learned counsel for the petitioner that the trial is lingering on and a direction be issued to the trial Court to conclude the trial expeditiously since expeditious trial is right of every accused. The petition in hand is accordingly dismissed. However, the Parvinder Singh 2018.06.01 18:06 I attest to the accuracy and integrity of this document Chandigarh

CRM-M No. 24679 of 2018 trial Court is directed to conclude the trial expeditiously avoiding granting adjournments just at the asking of the parties and fixing short dates. The trial be concluded preferably within a period of two months from the date of receipt of copy of this order in that Court.
