The petition has been filed seeking a writ of mandamus directing the respondents to grant one-time exemption to the petitioners from passing HTET, as per the Haryana School Education (Group-C) State Cadre Service Rules, 2012, being having more than four years experience as regular PTI Teacher, and to allow them to participate in the selection process for the post of TGT-Physical Education against advertisement no.2 of 2023, Annexure P-4.

Learned State counsel has placed reliance upon and it is not disputed at Bar that the issue raised in the instant petition already stands decided against the petitioners by a co-ordinate Bench vide judgment dated 21.03.2023 passed in Civil Writ Petition No.5864 of 2023, titled Annu v. State of Haryana and others. The judgment holds that cut-off date for submission of application forms for the posts in question cannot be extended as it will result in disruption of entire educational schedule. CWP No.5890 of 2023 -2- 2023:PHHC:145293 only exception can be when the cut-off date has been fixed arbitrarily or there is any technical defect in the process of submission of application forms. None of these situations arise in the instant petition, and the cut-off date, 20.3.2023, for submission of application forms in response to the advertisement has already passed.
