(Oral) The present petition raises challenge to the order dated 03.03.2023, whereby the learned trial Court has refused to supply the pen drive, which is the part of challan of the petitioner. Learned counsel for the petitioner has vehemently argued that there is contravention of Section 207 Cr.P.C, and the accused is entitled to complete copy of the challan including the statements, documents and pen drive. He further submits that, in fact, the pen drive has been held to be a document, and hence, he is entitled for the same. After hearing the learned counsel for the petitioner at length, I do not find any force in the said argument, for the reasons that the dignity of the girl and the reputation of not only the victim but also of the family cannot be put to stake.

2023:PHHC:043958 CRM-M-14662-2023 Admittedly, the pen drive contains certain objectionable photographs of the victim and the accused, and therefore, the supply of the same to the accused can cause the risk of leakage of the same, not only from accused but from anyone. Learned Court below has rightly granted the opportunity to the accused to inspect the contents of the pen drive, in the presence of learned APP and in the Court itself, which will be compliance of the intent and in substance of provisions of Section 207 of Cr.P.C. Finding no merit in the present petition, the same is dismissed.
